ATTO DI INFORMAZIONE EX ART. 13 DEL REGOLAMENTO UE N. 679/2016

Con specifico riferimento ai dati personali ex art. 4 n. 1 del Regolamento UE n. 679/2016 (d’ora in avanti solo “Regolamento UE”) che vi riguardano in qualità di soggetto “interessato” ex art. 4 n. 1 del Regolamento UE, la scrivente TEAM TEX sas, (d’ora in avanti “TEAM TEX”) (VAT FR 04 435340039), con sede legale in 11, rue du Claret, ZI de Montbertrand, 38230 Charvieu - France, in qualità di Titolare del trattamento ex art. 26 del Regolamento UE vi fornisce le seguenti informazioni ex art. 13 del Regolamento UE. 
Ai sensi dell’art. 26 comma II del Regolamento UE, il contenuto essenziale dell’accordo di contitolarità è messo a disposizione dei soggetti interessati, i quali  potranno farne richiesta al seguente indirizzo di posta elettronica: app@nania.com

1. Natura e tipologia dei dati raccolti e trattati.

1.1 I vostri dati oggetto di trattamento di cui alla presente informativa rientrano esclusivamente nella categoria dei dati personali ex art. 4 n. 1 del Regolamento UE, raccolti e successivamente trattati, da parte dei Contitolari, ai fini dell’esecuzione delle finalità illustrate nel successivo art. 3.

2. Informazioni sui Contitolari e sul Responsabile della Protezione dei dati cd. di gruppo.

2.1 Il soggetto Contitolare del trattamento ex art. 26 del Regolamento UE in riferimento ai dati personali illustrati al precedente art. 1.1. è TEAM TEX, che può essere contattata al seguente recapito: app@nania.com
Il Responsabile della Protezione dei dati cd. di gruppo ex art. 37 del Regolamento UE, nominato da TEAM TEX, è Stéphane BERNARD.

2.2 Si comunica che eventuali variazioni ovvero aggiornamenti circa i dati relativi ai soggetti poc’anzi indicati verranno idoneamente pubblicati all’interno dei siti web di ciascun Contitolare.

3.Finalità del trattamento.

3.1 Con specifico ed unico riferimento ai dati personali ex art. 4 n. 1 del Regolamento UE riferiti agli utenti utilizzatori dell’Applicazione mobile “B on Board” (d’ora in avanti solo “App”) concernente il relativo dispositivo mobile, TEAM TEX ha deciso di condividere le seguenti finalità di trattamento ex art. 4 n. 2 del Regolamento UE dei dati personali riguardanti i poc’anzi descritti soggetti interessati:

a. Corretto ed efficace utilizzo, da parte dell’utente, dell’App e dei servizi ad essa necessariamente connessi, ivi inclusa l’eventuale l’attività di registrazione (la quale può essere effettuata da soggetti maggiori di anni 14), da parte dell’utente, dell’App;

b. Attività di geo localizzazione e/o tracciamento, a seguito dell’attivazione dell’App e dei servizi ad essa necessariamente connessi da parte dell’utente;

c. Attività di profilazione sugli utenti dell’App, onde comporre categorie individuali ovvero di gruppo a livello statistico o di dettaglio, al fine così di migliorare la conoscenza dei bisogni e delle aspettative degli utenti ed al fine di proporre prodotti o servizi valutati e/o selezionati come vantaggiosi per gli utenti medesimi;

La finalità illustrata nella precedente lettera a) rientra nell’ipotesi di liceità ex art. 6 comma 1 lettera b) del Regolamento UE e, pertanto, non necessita del vostro consenso: a tal riguardo, i Contitolari vi comunicano che il vostro eventuale rifiuto al consenso alle finalità in questione determinerà l’impossibilità, da parte dei Contitolari, di provvedere ad un corretto ed efficace utilizzo, da parte vostra, dell’App e dei servizi ad essa necessariamente connessi.

Le finalità illustrate nelle precedenti lettere b), c) rientrano nell’ipotesi ex art. 6 comma 1 lettera a) del Regolamento UE e, pertanto, richiedono il vostro facoltativo consenso: in proposito, i Contitolari vi comunicano che il vostro eventuale rifiuto al consenso per l’esecuzione delle finalità in questione non determina alcuna tipologia di conseguenza in ordine alle finalità di trattamento descritte nella precedente lettera a).

4. Soggetti destinatari dei vostri dati raccolti e trattati da parte dei Contitolari.

4.1 I dati descritti all’art. 1.1. sono conservati in archivi ubicati presso le sedi dei Contitolari e/o su server situati all’interno dell’Unione Europea.

5. Periodo di conservazione dei dati.

5.1 In ossequio all’art. 13 comma 2 lettera a) del Regolamento UE, i Contitolari vi comunicano che il periodo di conservazione dei vostri dati descritti al precedente art. 1.1. e trattati per l’esecuzione delle finalità descritte nelle lettere a) e b) dell’art. 3.1. coinciderà con un termine non superiore al completo perseguimento delle finalità in questione, eventualmente prorogabile al fine di adempiere ad obblighi legali o contrattuali ovvero eventualmente derivanti dalla necessità di gestire un contenzioso giudiziale o stragiudiziale promosso da o nei confronti dei Contitolari.

6. Modalità di trattamento.

6.1 I Contitolari vi informano che i vostri dati illustrati all’art. 1.1. saranno trattati con strumenti cartacei, elettronici, telematici o informatici, nel pieno rispetto della legge nazionale ed europea in materia.

7. Principi applicati al trattamento dei Vostri dati personali.

7.1 Vi informiamo che i vostri dati descritti all’art. 1.1. saranno trattati nel pieno e totale rispetto dei principi espressi dall’art. 5 del Regolamento UE.

8. Diritti del soggetto Interessato.

8.1 In relazione ai vostri dati descritti all’art. 1.1., vi informiamo che avete il diritto di esercitare i diritti previsti dagli art. da 15 a 21 e da 77 a 78 del Regolamento UE.

8.2 In ossequio all’art. 12 comma 1 del Regolamento UE, i Contitolari si impegnano a fornirvi le comunicazioni di cui agli art. da 15 a 22 del Regolamento UE in forma concisa, trasparente, intellegibile, facilmente accessibile e con un linguaggio semplice e chiaro: tali informazioni saranno fornite per iscritto o con altri mezzi eventualmente elettronici ovvero, su richiesta dell’interessato, saranno fornite oralmente, purché sia comprovata con altri mezzi l’identità dell’interessato.

8.3 In ossequio all’art. 12 comma 3 del Regolamento UE, i Contitolari vi informano che si impegnano a fornirvi le informazioni relative all’azione intrapresa riguardo ad una richiesta ai sensi degli art. da 15 a 22 del Regolamento UE senza ingiustificato ritardo e, comunque, al più tardi entro un mese dal ricevimento della richiesta stessa; tale termine può essere prorogato di due mesi, se necessario, tenuto conto della complessità e del numero delle richieste.

8.4 Al fine di poter esercitare i diritti illustrati nel presente articolo, voi potete avvalervi dei dati di contatto specificati all’art. 2 della presente informativa.

With specific reference to personal data according to the art. 4 no. 1 of EU Regulation no. 679/2016 (hereafter only "EU Regulation") which concern you as an "interested" subject according to the art. 4 no. 1 of the EU Regulation, the writer TEAM TEX sas, (d’ora in avanti “TEAM TEX”) (VAT FR 04 435340039), con sede legale in 11, rue du Claret, ZI de Montbertrand, 38230 Charvieu - France, as Data Controller of the former art. 26 of the EU Regulation provides you with the following information according to the art. 13 of the EU Regulation.
According to the art. 26 paragraph II of the EU Regulation, the essential content of the joint ownership agreement is made available to interested parties, who can request it at the following email address: app@nania.com

1. Nature and type of data collected and processed.

1.1 Your data subject to processing referred to in this statement fall exclusively in the category of personal data according to the art. 4 no. 1 of the EU Regulation, collected and subsequently processed by the Joint Controllers, for the purpose of executing the purposes illustrated in the following art. 3.

2. Information on the Joint Data Controllers and the Data Protection Officer group.

2.1 The joint owner of the treatment according to the art. 26 of the EU Regulation with reference to the personal data illustrated in the previous art. 1.1. it is TEAM TEX, which can be contacted at the following address: app@nania.com. The Data Protection Officer cd. group ex art. 37 of the EU Regulation, appointed by TEAM TEX, is Stéphane BERNARD.

2.2 We inform you that any changes or updates regarding the data relating to the subjects indicated above will be suitably published on the websites of each Data Controller.

3. Purpose of the treatment.

3.1 With specific and unique reference to personal data according to the art. 4 no. 1 of the EU Regulation referring to users of the "B on Board" mobile application (henceforth only "App") concerning the relative mobile device, TEAM TEX has decided to share the following processing purposes according to the art. 4 no. 2 of the EU Regulation of personal data concerning the aforementioned interested parties:

a. Correct and effective use, by the user, of the App and the services necessarily connected to it, including any registration activity (which can be carried out by subjects over 14 years of age), by the user, of the App;

b. Geo-localization and / or tracking activities, following the activation of the App and the services necessarily connected to it by the user;

c. Profiling activities on App users, in order to compose individual or group categories at statistical or detail level, in order to improve the knowledge of users' needs and expectations and in order to propose products or services assessed and / or selected as beneficial to the users themselves;

The purpose illustrated in the previous letter a) falls within the hypothesis of lawfulness pursuant to art. 6 paragraph 1 letter b) of the EU Regulation and therefore does not require your consent: in this regard, the Joint Data Controllers inform you that your refusal to consent to the purposes in question will make it impossible for the Joint Data Controllers to provide a correct and effective use, on your part, of the App and the services necessarily connected to it.

The purposes illustrated in the previous letters b), c) fall under the hypothesis ex art. 6 paragraph 1 letter a) of the EU Regulation and, therefore, require your optional consent: in this regard, the Joint Data Controllers inform you that your refusal to consent for the execution of the purposes in question does not determine any type of consequence as regards the processing purposes described in letter a) above.

4. Recipients of your data collected and processed by the Joint Controllers

4.1 The data described in art. 1.1. they are kept in archives located at the headquarters of the Joint Controllers and / or on servers located within the European Union.

5. Data retention period.

5.1. In compliance with art. 13 paragraph 2 letter a) of the EU Regulation, the Joint Data Controllers inform you that the retention period of your data described in the previous art. 1.1. and processed for the execution of the purposes described in letters a) and b) of art. 3.1. will coincide with a term not exceeding the complete pursuit of the purposes in question, which may be extended in order to fulfill legal or contractual obligations or possibly deriving from the need to manage a judicial or extra-judicial dispute promoted by or towards the Joint Controllers.

6. Processing methods.

6.1 The Joint Data Controllers inform you that your data illustrated in art. 1.1. will be processed with paper, electronic, telematic or IT tools, in full compliance with the national and European law on the matter.

7. Principles applied to the processing of your personal data.

7.1 We inform you that your data described in art. 1.1. will be treated in full and total respect of the principles expressed in art. 5 of the EU Regulation.

8. Rights of the interested party.

8.1. In relation to your data described in art. 1.1., We inform you that you have the right to exercise the rights provided by art. from 15 to 21 and from 77 to 78 of the EU Regulation.

8.2. In compliance with art. 12 paragraph 1 of the EU Regulation, the Joint Controllers undertake to provide you with the communications referred to in art. from 15 to 22 of the EU Regulation in a concise, transparent, intelligible, easily accessible and in simple and clear language: this information will be provided in writing or by any other electronic means or, at the request of the interested party, will be provided orally, provided the identity of the interested party is proven by other means.

8.3. In compliance with art. 12 paragraph 3 of the EU Regulation, the Joint Data Controllers inform you that they undertake to provide you with information relating to the action taken regarding a request pursuant to art. from 15 to 22 of the EU Regulation without undue delay and, in any case, at the latest within one month of receiving the request; this deadline can be extended by two months, if necessary, taking into account the complexity and the number of requests.
